- if it is a second offense;
- if you are on parole or probation for any indictable offense, a.k.a felony level crime.
A third degree crime has a maximum penalty of 5 years in prison
A fourth degree crime has a maximum penalty of 18 months in prison.
The NJ Stalking statute is designated N.J.S.A. 2C:12-10.
