The amount of the items that were stolen determines the grade of the shoplifting charge. It is a Disorderly Persons offense if the full retail value is less than $200.00.
Shoplifting is 4th degree if the full retail value is at least $200.00 but not more than $500.00.
Shoplifting is 3rd degree if the full retail value exceeds $500.00 but is less than $75,000.00.
Also, Shoplifting is 3rd degree if it is characterized as an organized retail theft enterprise and the full retail value is less than $1,000.00.
Shoplifting is 2nd degree if the full retail value is $75,000.00 or more.
In addition, it is also 2nd degree if the Shoplifting occurs with an organized retail theft enterprise and the full retail value is $1,000.00 or more.
